TERMS OF USE, INFORMATION ON COOKIES, PRIVACY POLICY AND DATA PROTECTION POLICY of IRKL recruitment company.

Administrator - Institute for Human Capital Development Sp. z o.o. (IRKL) located at Partyzantów 1/2 lok. 3, 10-522 Olsztyn, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court in Olsztyn under KRS No. 0000493269, with fully paid-up share capital of PLN 10000, NIP No. 7393864869, REGON No. 281557957, registered as an employment agency in the National Register of Employment Agencies under No. 10485.

Website – a website available at www.irkl.pl with subpages and the content thereof as well as the official online activities of IRKL employees and partners: on online job boards; social media, including LinkedIn, Facebook, Twitter; activities within advertising networks.

User - a person visiting the Website.

Client - a user who responded to the offer listed on the Website by sending a form with an order for a product/service or by sending their contact details in order to start communication with the intent to learn about and potentially use, against payment, the Controller's products/services.

Part I - Privacy Policy

This privacy policy protects the rights of the Website Users regarding the collection and storage of data that the Users consciously or unconsciously share when using the Website.

  1. Under no circumstances does the Website provide third parties with data provided by the User and information that is automatically collected, processed and saved using the Website's IT system.
  2. All Website's subpages available at irkl.org, including the pages, on which the User may complete and send online forms are protected by encryption of communication (SSL certificate).
  3. The Website may contain contact or newsletter sign-up forms. When completing the forms, the User, by accepting these terms of use, agrees to receive information from the Controller via e-mail. E-mails sent to the User may be of informative, educational or commercial nature.

Part II – "cookies” mechanism,statistics and other data collection methods

  1. The website within irkl.pl uses the mechanism of "cookies". Cookies are small text files stored on the User's computer, used to remember the User's behavior on the website, which may affect the subsequent operation of the site, including the display of specific, user-tailored information and advertising. Cookies do not contain personal data and do not enable identification of a person. The condition for cookies to work is their acceptance by the browser and not deleting them from the computer disk.
  2. The Service as part of the irkl.pl website uses tools that collect statistical data or help the Administrator optimize the content served to the User, such as Google Analytics, Google AdWords, Google Optimize, Google Tag manager, Facebook Pixel and other analytical and optimization tools that have been installed within the Service website. The User may limit or disable such tools by disabling JavaScript or otherwise changing the settings of the browser used. The User may also set the appropriate level of protection and permissions for his/her Google, Facebook LinkedIn et al. account.

 

Part III - collecting candidates' personal dataas part of recruitment activities

  1. The Controller, which is a recruitment agency, uses the Website to gather candidates' applications in recruitment processes. To this end, the Website displays application forms, recruitment advertising and other information encouraging the User to participate in the recruitment processes and thus, to submit their personal data.
  2. The User voluntarily sends personal data collected through online forms, e-mails sent directly to the Controller, online job boards by giving their consent to the processing of data by the Controller in accordance with the following clause:

Information clause for IRKL candidates

"According to Article 13 (1) and (2) of the og.óof the General Data Protection Regulation of April 27, 2016, I inform you that:

   1) The administrator of your personal data is the Institute for Human Capital Development Sp. z o.o. (IRKL) based in Olsztyn, at Partyzantów ½ lok.3, 10-522 Olsztyn. . IRKL is a recruitment company, an employment agency conducting numerous recruitment processes on behalf of other entities or for its own use. IRKL's recruitment powers can be checked in the National Register of Employment Agencies under number 10485.

   2) The data protection officer (DPO) at the Institute for Human Capital Development Ltd. is Grzegorz Figoń, iod@irkl.pl, tel. 570 40 10 10;

   3) your personal data will be processed for the purpose of participating in this and future recruitment processes conducted by IRKL pursuant to art. 6(1)(a) of the General Data Protection Regulation of 27 April 2016;

   4) The recipients of your personal data will be: a) IRKL employees who carry out recruitment processes; b) employers on whose behalf IRKL carries out recruitment processes;

   5) Your personal data will be transferred to a third country/international organization based on the European Commission's adequacy decision EU-US Privacy Shield dated July 12, 2016. You may obtain a copy of the personal data transferred to a third country by sending a request to IOD: iod@irkl.pl;

   6) your personal data will be stored for the period from giving consent to the current and future recruitment processes corresponding to your professional experience to revoking the consent;

   7) You have the right of access to the content of your data and the right to rectification, erasure, restriction of processing, the right to data portability, the right to object, the right to withdraw consent at any time without affecting the legality of the processing performed on the basis of consent before its withdrawal. Withdrawal of consent, request for access or correction of data can be reported to the DPO by writing to: iod@irkl.pl;

   8) you have the right to lodge a complaint with the President of the Personal Data Protection Office, if you believe that the processing of your personal data violates the provisions of the General Data Protection Regulation of 27 April 2016;

   9) providing your personal data is voluntary;

   10) your data will not be subject to a decision based solely on automated processing, including profiling, in accordance with art. 22 of the Personal Data Protection Regulation of 27 April 2016. "

(3) The Administrator shall reject the User's application, deleting the personal data received, if the User does not consent to the processing of his/her personal data through the forms displayed on the Website or by including the appropriate consent formula in the submitted resume/vitae file, or includes such consent in the message sent to the Administrator by e-mail, through advertising or social networking sites.

Information clause for IRKL clients

"In accordance with art. 13(1) and (2) of the General Data Protection Regulation of 27 April 2016 we inform that:

1) the Controller of your personal data is Instytut Rozwoju Kapitału Ludzkiego Sp. z o.o. (IRKL) with its registered office in Olsztyn, at ul. Partyzantów ½ apart. 3, 10-522 Olsztyn. IRKL is a recruitment company, a job agency conducting numerous recruitment processes for behalf of other entities or for its own purposes. Recruitment license of IRKL may be verified in the National Register of Employment Agencies under number 10485.

2) the data protection officer (IOD) at Instytut Rozwoju Kapitału Ludzkiego Sp. z o.o. is Grzegorz Figoń, iod@irkl.pl, tel. 570 40 10 10;

3) your personal data will be processed for the purpose of presenting an offer and establishing cooperation related to the recruitment processes carried out by IRKL pursuant to art. 6(1)(a) of the Personal Data Protection Regulation of 27 April 2016;

4) the recipients of your personal data are: a) employees of IRKL carrying out the recruitment processes; b) candidates participating in the recruitment processes conducted by IRKL;

5) your personal data will be transferred to a third country/international organization on the basis of the decision of the European Commission on the adequacy of the protection provided by the EU-US Privacy Shield of July 12, 2016. You can get a copy of personal data transferred to a third country by sending a request to the Data Protection Officer at iod@irkl.pl;

6) your personal data will be stored for the period from giving consent to the current and future recruitment processes corresponding to your professional experience to revoking the consent;

7) you have the right to access the content of your data and correct, delete, transfer, limit their processing, object their processing, and withdraw consent to their processing at any time without any effect on the lawfulness of the processing, which took place based on the consent before its withdrawal. To withdraw the consent, get access to or correct data please contact the Data Protection Officer at iod@irkl.pl;

8) you have the right to lodge a complaint with the President of the Personal Data Protection Office, if you believe that the processing of your personal data violates the provisions of the General Data Protection Regulation of 27 April 2016;

9) providing your personal data is voluntary;

10) your data will not be subject to a decision based solely on automated processing, including profiling, in accordance with art. 22 of the Personal Data Protection Regulation of 27 April 2016. "

Part IV - Ordering commercial services

1) The Controller publishes commercial offers of products and services on the Website pages, hereinafter referred to as the Offers.

2) The Offers published on the Website contain the terms of future transactions and descriptions of the manner of performance of services and, in some cases, the price. The prices displayed on the Website pages are net prices, to which VAT should be added.

3) Ordering products/services by accepting the Offer does not constitute an obligation to pay. Once the Client orders the Offer, the Controller will send them a proforma invoice. Paying for a proforma invoice is equivalent to accepting the terms and concluding a contract for the performance of the service/supply of the product on the terms described in the Offer.

4) The Client has the right to broaden their knowledge of the selected Offer prior to concluding a transaction. For this purpose, they shall contact the Controller through contact forms available within the Website or by phone to the telephone numbers provided.
